SMISH shop terms
SMISH toys are sold by KUSHA LLC (ООО «КУША»). These terms cover the catalogue, basket, favourites, account, ordering and purchase support on smish.ru.
Users must act in good faith, respect other people’s rights and comply with Russian law. Confirming a purchase also makes the terms displayed during checkout applicable to that order.

2. Products and prices
The shop aims to keep descriptions, images, specifications, prices and availability information current. Read the chosen toy’s specifications before ordering. On-screen appearance, packaging colours and some design details may differ from the product provided its stated consumer properties are unaffected.
Adding an item to the basket or favourites does not reserve stock or lock its price. The shop checks the items again at checkout and displays current prices. An item being available to order is not confirmation of stock on hand.
If an obvious technical error in price, description or availability is found before confirmation, the seller contacts the buyer to agree corrected terms or cancel the affected item.
3. Placing an order
Provide accurate buyer and recipient details, a contact method and a delivery destination. Before confirming, check the items, quantities, delivery charge, payment method and total.
Buyers are responsible for accurate details and timely notice of changes. After creation, the order receives a number and purchase details may be sent to the supplied contacts. Keep the number for enquiries. Contact the seller promptly if corrections are needed; changes depend on the stage of fulfilment.
If all or part of the order cannot be fulfilled, the seller agrees an appropriate option with the buyer, such as replacement, a different quantity, revised timing or cancellation of the affected part.
4. Payment and delivery
Available options depend on the items, destination and collection method. Delivery charges and conditions, payment methods and any carrier-supported dates or time slots are shown at checkout before confirmation.
Delivery charges and estimated timing are calculated for the selected basket and destination. General delivery information does not replace the terms displayed for the particular order before confirmation.
For online payment, the shop opens the payment provider’s page. Enter card details there; the provider’s rules also govern the transaction. You can check payment and delivery status in your order; opening the payment page does not itself confirm payment.
5. Returns and purchase enquiries
Contact KUSHA LLC about quality, cancellation, exchanges, returns or correction of defects. Where possible, provide the order number, item and an explanation. The seller may request photographs, documents or other information needed to assess the enquiry.
Buyer rights are governed by Russian consumer protection law, taking account of the product category, its condition and the purchase circumstances. These terms do not reduce mandatory buyer rights or the seller’s statutory liability.
6. Customer accounts
Sign-in uses a one-time code delivered by phone or email. Keep codes private and sign out on shared devices. Contact the shop if you suspect unauthorised access.
The account offers the functions currently available in the interface, such as profile details, addresses, basket, favourites, orders and notification preferences. Guest checkout can be used when available. An order number alone does not grant access to personal information.
7. Data and messages
KUSHA LLC’s handling of customer information is described in the seller privacy policy. Processing by the website owner and analytics are covered by the SMISH website privacy policy; separate choices are described in the personal data consent.
Accepting purchase terms does not opt you into advertising or analytics. These are separate choices.
8. Using the shop and changes
Bypassing access restrictions, obtaining other people’s data, distributing malicious code and disruptive automated traffic are prohibited. Automated collection of public information is permitted only where it respects site operation, the seller’s and others’ rights, and the law.
Text, photographs, artwork, design, logos, code and other materials may be protected by intellectual property rights. Use beyond ordinary viewing requires the rights holder’s permission or a legal exception. Manufacturers’ marks and materials belong to their respective rights holders.
The shop takes reasonable steps to operate reliably and securely. Maintenance, connection failures or external service outages may temporarily limit features. This does not exclude the seller’s mandatory statutory liability.
Terms may change as shop operations or legal requirements change. An updated version takes effect on publication unless it specifies another date. Existing orders retain the terms agreed when placed, together with applicable legal requirements.
